In these Terms, “WedUpload”, “we”, “us” or “our” refers to the service provided by Jellybean Photobooth Limited.

By purchasing or using WedUpload  you agree to these Terms. If you do not agree, you must not use the service.

1. Description of Service

WedUpload provides digital QR code galleries for events (such as weddings).

Upon payment (currently £20 unless otherwise stated), customers can:

• Create an online event gallery

• Generate a QR code for guest uploads

• Allow guests to upload and view photos

• Download all uploaded media during the active period

The gallery is licensed for use for one specific event on the date specified at purchase.

2. Account Setup & Payment

• Full payment is required before the gallery is activated.

• The gallery is created upon successful payment.

• By completing purchase, you acknowledge that the digital service has begun immediately.

WedUpload reserves the right to amend pricing at any time, but this will not affect existing purchases.

3. Gallery Usage Rules

3.1 Event-Specific Use
The gallery is licensed for use solely for the event and date specified during purchase. It must not be reused for other events.

3.2 QR Code Security
You are responsible for:

• Sharing the QR code securely

• Ensuring it is only distributed to intended guests

• Monitoring access where necessary

If the QR code is shared publicly or results in unauthorised access, WedUpload reserves the right to immediately suspend or permanently close the gallery without refund.

4. Content Responsibility

You (the purchaser) are fully responsible for:

• All content uploaded by you or your guests

• Ensuring content complies with UK law

• Ensuring no copyright infringement occurs

• Ensuring no unlawful, defamatory, abusive, hateful, explicit, or illegal material is uploaded

WedUpload does not actively moderate all content but reserves the right to remove content or suspend access if:

• It breaches the law

• It violates these Terms

• It exposes us to legal or reputational risk

Repeated or serious breaches may result in gallery closure without refund.

5. Content Ownership

All photos and media uploaded remain the property of the customer (and/or the original creator).

By uploading content, you grant WedUpload a limited, non-exclusive licence to:

• Store

• Process

• Display

• Back up

the content solely for the purpose of providing the service.

WedUpload will not sell, licence, or use uploaded content for marketing without explicit written permission.

6. Storage & Retention

• Galleries remain live for a minimum of 6 months from the event date.

• After 6 months, all content may be permanently deleted.

• No reminders will be issued prior to deletion.

• Customers are responsible for downloading all media before expiry.

Once deleted, content cannot be recovered.

All data is stored on WedUpload’s website infrastructure and securely backed up on Jellybean Photobooth servers and cloud services.

7. Refund Policy

WedUpload is a digital service.

Because the gallery is created and made available immediately upon purchase, refunds are limited.

Refund eligibility:

• Within 24 hours of purchase (and if the gallery has not been used): Full refund

• After 24 hours: No refund

• After event date or once uploads have occurred: No refund

If a gallery is closed due to breach of these Terms (including QR misuse or unlawful uploads), no refund will be issued.

Refund requests must be submitted in writing.

8. Service Availability

WedUpload is provided on an “as available” basis.

We do not guarantee:

• Uninterrupted access

• Error-free operation

• Continuous uptime

• Compatibility with all devices

We are not liable for:

• Guest device failures

• Internet connectivity issues

• Third-party hosting outages

• Loss of access caused by user error

9. Limitation of Liability

To the fullest extent permitted by law, Jellybean Photobooth Limited shall not be liable for:

• Loss of content

• Loss of profits or revenue

• Indirect or consequential loss

• Unauthorised access resulting from user sharing of QR codes

Nothing in these Terms limits liability for death, personal injury, fraud, or any liability that cannot be excluded under UK law.

10. Termination

We reserve the right to suspend or terminate access without refund if:

• These Terms are breached

• The service is used unlawfully

• Content creates legal or reputational risk

11. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
